The Telephone Consumer Protection Act, passed in 1991, requires prior express consent for non-emergency autodialed, prerecorded, or artificial voice calls to wireless phone numbers, as well as for pre-recorded telemarketing calls to residential wireline numbers. Dealer vendors and dealers must be constantly vigilant that their online interactions with consumers are all clearly presenting TCPA disclosures and capturing consumer consent in order to protect themselves from potential lawsuits and protect consumers from unwanted outreach.
